Possessing a higher advanced degree (above bachelor’s), i.e., a master’s degree,

Or attaining the exceptional ability requirements.

Bear in mind the applicant’s student visa status. Most students are in the U.S. on an F-1 visa, which does not permit immigrant intent. Second, if the F-1 holder intends to either apply for an OPT or renew/extend the F-1 visa, the immigration officer might examine the non-immigrant intent again for the OPT or renewal/extension application. A USCIS memo states that filing for I-140 does not always remove non-immigrant intent. The USCIS officer will analyze the circumstances of the petitioner to determine immigrant intent, such as if a foreign residency is maintained, the applicant’s connections to the home country, and when the I-140 was filed.
