Required Evidence for an EB-1C Petition
An application for an international manager or executive must include a letter from an authorized officer of the sponsoring U.S. employer. This letter should detail the duration of the U.S. company’s operations, the relationship between the overseas and U.S. entities, and the tenure of the foreign manager/executive with the overseas company.
If the non-resident manager/executive has been working outside the U.S. for at least one year in an executive or managerial capacity within the three years preceding the petition filing, this should be documented. This employment can be with a corporation, firm, official unit, associate, or division thereof.
Alternatively, if the non-resident manager/executive has been employed within the U.S. by the same company, unit, or associate for which they worked overseas, for at least one year in a managerial or executive role within the three years prior to their non-resident status, this should be demonstrated.
Additionally, the prospective U.S. employer must be the same company, unit, or associate as the firm or corporation for which the non-resident manager/executive worked overseas. Moreover, the U.S. employer must have been operational for at least one year.
